Jeff Skilling’s lawyer has presented arguments for a new trial to a three-judge panel of the Fifth Circuit. The centerpiece of his case, of course, is the Supreme Court’s ruling that “honest services” fraud was limited to bribery and kickbacks, neither of which were involved in the Skilling case.

Jeffrey Skilling has been denied bail during the appeal he won from the Supreme Court. It was a one-sentence ruling, not much to go on, except to note the comparison with Conrad Black, who got bail.

Jeff Skilling has requested that he be granted release on bail while his case is being considerate by an appeals cout, just as Conrad Black was released on bail while his case is being considered by an appeals court. The Supreme Court ordered that the convictions of both executives be reconsidered in light of the same decision, namely, the high court’s decision that the doctrine of “honest services” fraud had been applied in an overbroad manner.

The big news of the day, clearly, is that the U.S. Supreme Court has struck down the current, extremely broad interpretation of the "honest services" doctrine, under which Conrad Black and Jeff Skilling were convicted. Congratulations to our friends at the Pacific Research Institute (Timothy Sandefur) and the Cato Institute (Timothy Lynch), who filed an amicus brief in the case. A lot more comment tomorrow.
